Citizens’ Gavel Calls for Thorough Investigation into Conflicting Court Orders on Kano Emirate Throne Tussle

Citizens’ Gavel, a human rights organization, has urged the National Judicial Council (NJC) and the Nigerian Bar Association (NBA) to thoroughly investigate the conflicting court orders surrounding the Kano Emirate throne tussle between reinstated Emir Muhammadu Sanusi and Ado Bayero, who was deposed by Kano State Governor Abba Yusuf.

Commendation for Chief Justice’s Intervention

The Chief Justice of Nigeria, Olukayode Ariwoola, has summoned the Chief Judges of the Federal High Court and the Kano State High Court to address the issue. Citizens’ Gavel commended this action, emphasizing that the judiciary’s credibility is at stake if such conducts leading to disrepute are not corrected.

The Role of Courts and Lawyers

Nelson Olanipekun, Team Lead at Citizens’ Gavel, expressed concern over the courts and some lawyers allowing themselves to be used to the detriment of the legal profession and the peace in Kano State. He highlighted the recent NJC sanctions against three judges for malfeasances, pointing out the subsequent controversial actions of Justice A.M. Liman of the Federal High Court and Justice Amina Adamu Aliyu of the Kano State High Court.

Conflicting Court Orders

Justice Liman issued an ex parte order on May 23, 2024, suspending the implementation of the Kano State Emirate Council (Repeal) Law, 2024. This law led to Alhaji Aminu Ado Bayero’s deposition and Muhammadu Sanusi II’s installation as Emir. Four days later, Justice Amina Adamu Aliyu issued an ex parte order conflicting with Liman’s, restraining Bayero from parading as Emir and directing security agencies to take over his residence. Justice S.A. Amobeda of the Federal High Court further complicated matters by issuing an ex parte order affirming Justice Liman’s earlier order.

Public Unrest and Government Action

These conflicting orders have sparked protests in Kano State, leading Governor Yusuf to ban public demonstrations and direct security forces to arrest those involved. Citizens’ Gavel noted the critical role of the Chief Justice and the NBA President in summoning and investigating the judges and lawyers involved in these orders.
