Renowned human rights lawyer Femi Falana has announced his intention to take legal action against the recent increase in electricity tariffs for premium consumers in Nigeria, which saw a surge of over 230 percent. Speaking on Channels Television, Falana criticized the federal government’s plan, facilitated by the Nigerian Electricity Regulatory Commission (NERC), to extend the tariff hike beyond premium consumers to other categories.
Falana argued that the increase, which burdens consumers, cannot be justified under the Electricity Act of 2023. He accused the government of making Nigerians pay for the inefficiency and profligacy of those managing the electricity sector, despite the removal of electricity subsidy in 2022.
NERC announced the tariff increase on April 3, 2024, affecting customers who enjoy 20 hours of power supply daily. Falana challenged the government’s assertion of electricity subsidy, claiming it is non-existent and aimed at raising funds for cash-strapped Distribution Companies (Discos).
The lawyer criticized the government’s insensitivity to Nigerians grappling with the economic impact of petrol subsidy removal and forex market collapse. He cited conflicting statements by government officials regarding electricity subsidy, calling for an investigation into the matter.
In response, NERC urged customers to report any unjustified billing or band swaps by Discos. The regulator assured affected customers of refunds for erroneous deductions and emphasized the importance of monitoring service quality and reporting discrepancies.
