data-end=\"130\">Abuja, April 10, 2025<\/em> \u2014 President <strong data-start=\"143\" data-end=\"164\">Bola Ahmed Tinubu<\/strong> and the <strong data-start=\"173\" data-end=\"217\">Attorney-General of the Federation (AGF)<\/strong>, <strong data-start=\"219\" data-end=\"242\">Lateef Fagbemi, SAN<\/strong>, were notably absent on Thursday at the Federal High Court in Abuja, where hearing was scheduled in a suit challenging the appointment of <strong data-start=\"381\" data-end=\"423\">Vice Admiral Ibok-Ete Ekwe Ibas (Rtd.)<\/strong> as Sole Administrator of <strong data-start=\"449\" data-end=\"465\">Rivers State<\/strong>.<\/p>\n<p class=\"\" data-start=\"468\" data-end=\"768\">Presiding over the matter, <strong data-start=\"495\" data-end=\"521\">Justice James Omotosho<\/strong> adjourned the suit to <strong data-start=\"544\" data-end=\"561\">June 11, 2025<\/strong>, following confirmation from the plaintiff\u2019s counsel, <strong data-start=\"616\" data-end=\"638\">Mr. Chimezie Enuka<\/strong>, that while most parties had been served, the Attorneys-General of <strong data-start=\"706\" data-end=\"717\">Zamfara<\/strong> and <strong data-start=\"722\" data-end=\"732\">Bauchi<\/strong> States were yet to receive service.<\/p>\n<p class=\"\" data-start=\"770\" data-end=\"1131\">The plaintiff, <strong data-start=\"785\" data-end=\"809\">Mr. Johnmary Jideobi<\/strong>, an Abuja-based legal practitioner, is asking the court to declare President Tinubu\u2019s appointment of a Sole Administrator for Rivers State as <strong data-start=\"952\" data-end=\"972\">unconstitutional<\/strong>, asserting that there is no legal or constitutional basis for the President to suspend or remove a sitting governor and deputy governor in any Nigerian state.<\/p>\n<hr class=\"\" data-start=\"1133\" data-end=\"1136\" \/>\n<h3 class=\"\" data-start=\"1138\" data-end=\"1179\">Highlights of the Plaintiff\u2019s Demands<\/h3>\n<p class=\"\" data-start=\"1181\" data-end=\"1252\">In the suit marked <strong data-start=\"1200\" data-end=\"1223\">FHC\/ABJ\/CS\/572\/2025<\/strong>, Jideobi asked the court to:<\/p>\n<ul data-start=\"1254\" data-end=\"1685\">\n<li class=\"\" data-start=\"1254\" data-end=\"1359\">\n<p class=\"\" data-start=\"1256\" data-end=\"1359\"><strong data-start=\"1256\" data-end=\"1293\">Nullify all decisions and actions<\/strong> taken by Vice Admiral Ibas as Sole Administrator of Rivers State.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1360\" data-end=\"1549\">\n<p class=\"\" data-start=\"1362\" data-end=\"1549\">Issue an <strong data-start=\"1371\" data-end=\"1404\">order of perpetual injunction<\/strong> restraining President Tinubu from suspending or removing any state governor or deputy governor, or appointing a Sole Administrator in any state.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1550\" data-end=\"1685\">\n<p class=\"\" data-start=\"1552\" data-end=\"1685\"><strong data-start=\"1552\" data-end=\"1581\">Set aside the appointment<\/strong> and swearing-in of Ibas, and direct him to <strong data-start=\"1625\" data-end=\"1656\">vacate the Government House<\/strong> in Rivers State immediately.<\/p>\n<\/li>\n<\/ul>\n<hr class=\"\" data-start=\"1687\" data-end=\"1690\" \/>\n<h3 class=\"\" data-start=\"1692\" data-end=\"1727\">Constitutional Questions Raised<\/h3>\n<p class=\"\" data-start=\"1729\" data-end=\"1986\">Central to the suit is the constitutional legality of President Tinubu\u2019s alleged suspension of the elected Governor and Deputy Governor of Rivers State on <strong data-start=\"1884\" data-end=\"1902\">March 18, 2025<\/strong>, and his subsequent appointment of a retired naval officer to administer the state.<\/p>\n<p class=\"\" data-start=\"1988\" data-end=\"2255\">The plaintiff is seeking judicial interpretation on whether, under the <strong data-start=\"2059\" data-end=\"2093\">1999 Constitution (as amended)<\/strong>, any provision permits the President to <strong data-start=\"2134\" data-end=\"2167\">intervene in state governance<\/strong> by suspending duly elected officials and installing a federal appointee in their place.<\/p>\n<p class=\"\" data-start=\"2257\" data-end=\"2535\">He cited sections <strong data-start=\"2275\" data-end=\"2306\">1, 5(2), 180, 188, 189, 305<\/strong>, and <strong data-start=\"2312\" data-end=\"2319\">306<\/strong> of the Constitution, arguing that none grant such powers to the President, and that the only legal grounds for a governor\u2019s removal are by <strong data-start=\"2459\" data-end=\"2481\">expiration of term<\/strong>, <strong data-start=\"2483\" data-end=\"2498\">impeachment<\/strong>, <strong data-start=\"2500\" data-end=\"2514\">incapacity<\/strong>, or <strong data-start=\"2519\" data-end=\"2534\">resignation<\/strong>.<\/p>\n<hr class=\"\" data-start=\"2537\" data-end=\"2540\" \/>\n<h3 11, 2025<\/strong>, legal observers say the case could set a significant precedent for the <strong data-start=\"3070\" data-end=\"3102\">limits of presidential power<\/strong> in Nigeria&#8217;s federal system.
