Godwin Emefiele May Regain Freedom as Court Orders His Release, If Not Charged

Justice Hamza Muazu of the High Court of the Federal Capital Territory, sitting in Maitama, has issued an order for the Department of State Services (DSS) to release the suspended Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, or charge him to court within seven days. The order was made in response to a fundamental rights enforcement suit filed by Emefiele, challenging his detention by the DSS.

In the suit, Emefiele requested the court to uphold his right to liberty and freedom of movement, asserting that there was no valid reason for his continued detention. However, both the Attorney General of the Federation and the DSS argued that the detention of the suspended CBN Governor was lawful.

In its ruling, the court determined that it was unlawful for the Federal Government to continue detaining Emefiele without bringing charges against him in court.
